We Won't be Undersold ! Policy
Orbit Communication guarantees the Lowest Prices in North America on DIRECTV Products only. If, in the unlikely event, after buying from us, you find a lower price from an authorized DIRECTV retailer, on the identical item within 10 days of purchase, Orbit Communications will refund the difference to you. The competing price must be advertised in a printed, verifiable publication and be readily available to the general public. Bankruptcy, Model Close Out, Web Sites and Distress Sales are excluded. We reserve the right to determine eligibility of our Guaranteed Lowest Price offer. Again because a website can be easily created and removed off the Internet, Orbit Communications does NOT price match Internet websites. Any product returned after shipment is subject to a minimum of 20% restocking fee. Because Electronics prices change on a daily basis Orbit Communication Corp. does not offer price protection against itself. If you purchased a product and the prices changed the next day, Orbit will not price protect you.

Sales Policy

If payment is late, a 1.5% monthly finance charge will be applied to the outstanding balance. All sales are final. There is a 20% restocking fee for special order items and products approved by Orbit for return. You must call Orbit Communications at 1-800-576-7248 for a return authorization number. Any merchandise received without an authorization number will be returned to the sender. All Prices and Availability are subject to change without notice. All Software, Video and DVD sales are final. Existing DIRECTV Customer Activation and Sales Agreement

Orbit Communication Corp. (Orbit) sells DIRECTV System equipment at a price that is substantially below our cost and relies on a dealer rebate program that is in place "if certain conditions are met". In order to purchase one of these systems at our published prices, YOU MUST agree to the following terms and conditions:

Please read carefully.

  1. You must purchase a complete DIRECTV System AND you must be a first time DIRECTV customer.  Our published prices are available only to first time DIRECTV customers who are purchasing a complete system. You represent and warrant hereby that neither you nor anyone in your household and this residence address has ever had DIRECTV Service.
     

  2. You must reside in a residential, non-commercial dwelling within the continental United States and be at least 18 years of age. You acknowledge and agree that you may purchase only one system offer per household at these prices.
     

  3. You must activate your DIRECTV equipment with at least the TOTAL CHOICE or OPCION EXTRA ESPECIAL ($33.99/mo.) or Higher Package. If you are purchasing a DIRECTV System or Receiver with TiVo or UltimateTV you agree to activate that service within thirty (30) days of receipt. The date of receipt for the purposes of this agreement shall mean the date upon which you or anyone on your behalf signed for shipment according to shipping company records. You understand and agree that if you fail to activate your UltimateTV or TiVo service for any reason within thirty (30) days of receipt you acknowledge and agree that you will be charged a separate charge of $350 for each DIRECTV with TiVo and DIRECTV with UltimateTV receiver in addition to the $400 Non-activation fee.
     

  4. Upon receipt of your equipment you must log on to your account online www.orbitsat.com/youraccount.asp to obtain your DIRECTV Account Number.  If not previously received via electronic mail then upon receipt of your equipment, you MUST Call Orbit Communications (Orbit) to obtain your DIRECTV Account Number.
     

  5. You MUST use the DIRECTV System purchased from Orbit as your primary system.  Should you wish to buy an additional receiver from another retailer (Not recommended), DO NOT purchase it prior to the full installation and activation of the system from Orbit. Otherwise, the retailer from which you buy the additional unit will submit a request for DIRECTV to attach your name to their dealership. If this happens, you acknowledge and agree that you will be charged an additional $300.00 by Orbit.
     

  6. Return Policy. You may return the UNOPENED system prepaid within 30 days of receipt for a refund minus shipping charges. Returned systems must include all original items. You acknowledge and agree that there is a minimum 20% restocking fee for unopened product approved by Orbit for return plus all applicable shipping charges. IF the product you are returning was purchased for an invoice price of  $0.00 then the restocking fee will be calculated based on the retail value at the time of purchase. If any card associated with the equipment purchased has been activated you acknowledge that there will be a fifty dollar ($50.00) Access Card Charge. DIRECTV service fees are not refundable. For instructions on returning your DIRECTV System, you must log on to your account and request a return authorization number. Any merchandise received without an authorization number will be returned to the sender.
     

  7. NRTC Validation. I hereby state that I have checked my installation ZIP code against Orbit Communication Corp.'s Web site, and am not in an area served by the members or affiliates of the National Rural Telecommunications Cooperative.  When activating service if the company is other than DIRECTV i.e. "Pegasus" I agree NOT to activate my equipment and request a Return Authorization (Subject to all return fees). Should Orbit be charged back because my address is located in an NRTC territory I agree to pay them in full the full chargeback amount.  If you are in an NRTC Area, TiVo and UltimateTV Products are subject to an additional $350.00 charge if service is activated in an NRTC territory.
     

  8. Additional Terms and Conditions.  

    A)        You hereby expressly give Orbit Communication Corp. permission to charge your credit card for any of the charge backs outlined in this agreement.  
    B)       
    This agreement and order form are governed by the laws of the Commonwealth of Massachusetts. You agree that any disputes arising under this Agreement shall be heard and determined by a court of competent jurisdiction in the Commonwealth of Massachusetts. You agree that the courts of the Commonwealth of Massachusetts shall have both subject matter and personal jurisdiction over all parties to this agreement without regard to conflicts of laws principles.  

    C)        You acknowledge that should your product be defective or stop working after you have installed it, Orbit will not replace it. You agree to contact the manufacturer of the equipment directly for repair or replacement under the manufacturers warranty. All manufacturers warranties are in full effect at the time of shipment by Orbit. If you have to send your DIRECTV Receiver back to the manufacturer for warranty service please DO NOT ship the Access card with the equipment. Keep the Access card and insert it in the replacement unit you receive. Failure to do so will result in a chargeback. 

    D)        Should you fail to activate your receiver(s) or fail to pay Orbit for any of the applicable charge backs provided for in this agreement, you hereby expressly authorize Orbit to report the outstanding balance due plus all reasonable legal fees to all credit agencies as delinquent.

You agree that if Orbit discovers that you are already a DIRECTV customer, then you hereby authorize Orbit to add the Previous Customer Charge of up to $500.00 to your invoice and to ship your system to you without the need to notify you.

                F)  Sorry, no DIRECTV orders will be shipped outside the continental U.S.A.

You acknowledge and agree that there is a minimum 20% restocking fee for unopened and a minimum of 35% for opened items product approved by Orbit for return plus all applicable shipping charges. IF the product you are returning was purchased for an invoice price of  $0.00 then the restocking fee will be calculated based on the retail value at the time of purchase. If any card associated with the equipment purchased has been activated there you acknowledge that there will be a fifty dollar ($50.00) Access Card Charge. DIRECTV service fees are not refundable. For instructions on returning your DIRECTV System, you must log on to your account and request a return authorization number. Any merchandise received without an authorization number will be returned to the sender.

Dish Network Pricing and Sales Policies

1. You indicate your agreement to the following terms and conditions for the goods and services that you are ordering.

2. You and all members of your household are first time Dish Network subscribers living in the United States of America. No one in the household has ever subscribed to one year of Dish Network programming before. One system per household. If purchasing system as a gift, purchaser is liable for all terms and conditions described herein.

3. The satellite equipment will be used exclusively for residential satellite programming by Dish Network within the intended household. You agree that this system is not for a commercial location such as a Office, School, Hospital, Bar or Restaurant. If you need a system for a commercial location call Orbit Communication at 1-800-576-7248 .

4. You will activate the system purchased as the primary system in your household with Americas Top 50, Top 100  or better programming depending on the promotion selected (See Page and Terms for Details) within 30 days from invoice date.

5. If part of this order. You will activate all standalone receivers purchased during this time as well. You will maintain this programming for a continuous 12 months on all receivers and will pay Dish Network the full amount of each of at least 12 paid invoices. You will not cut the programming off during this time for any reason whatsoever.  The access card supplied with each receiver will only be used in the satellite receiver for which it is designated and will not be modified or replaced in any way.

6. All Multiple Receiver Systems purchased must be activated with the highest model receiver as the primary and the other receivers as standalone receivers. Failure to do so may result in a charge of up to $155.

7. All returned systems and receivers must be received within 30 days of receipt, accompanied with an RA#. If the system is not received within the 30 days, all of the contractual conditions above apply in full. All returned satellite systems will incur a minimum of 20% restocking fee

8. You further agree and understand that by accepting delivery of the Dish Network system, by activating your Dish Network  programming package, you will be bound by all the terms of this contract, including the aforesaid waiver of signature and aforesaid early cancellation fee.

9. You agree to pay Orbit Communication Corp. $350.00 should any of the conditions of sale above not be met. You authorize Orbit Communication Corp. to charge the credit card used in the transaction for this amount. You further agree, should the funds not be approved, to pay Orbit Communication Corp. $350.00 plus all collection fees and legal fees associated with the collection of this amount.  Obit Communication does report delinquent account to all major credit bureaus.

10. You acknowledge that you have read and understand the terms and conditions of this transaction by signing below. All provisions stated above are part of a binding contract, governed by the state of Massachusetts to purchase a Digital Satellite System at our stated prices from Orbit Communication Corp.

11. Should I fail to activate my receiver(s) and fail to pay Orbit for any NONE Activation charges. I authorize Orbit to report the balance due plus all reasonable legal fees to all credit agencies as delinquent.

12. I give Orbit Communication Corp. permission to charge my credit card should I violate this agreement.

I acknowledge and agree to the following contract provisions. The parties acknowledge that the signature below names of the parties shall constitute acceptance of this contract.

Shipping Terms

In effort to fight credit card fraud, and for the customer's own protection,  Orbit Communications will not provide anyone with a tracking number by phone you must logon to your online account to obtain your tracking number. If your package is more than 10 days late, an Orbit Communications representative will be happy to track it for you.

DISH NETWORK

All prices and packages subject to change without notice. Local and state sales taxes may apply. Programming is available for single-family dwellings located in the continental United States and its territories and possessions. All DISH Network programming, subscription programming, programming packages, pay-per-view services, and any other service that we provide to you, are subject to the terms and conditions of the residential customer agreement, which is available to you upon request. *ABC, CBS, NBC and FOX Channels are only available: (1) for private home viewing; (2) to households that cannot receive an acceptable off-air picture with the use of a conventional rooftop antenna; and (3) in households that have not received that network by cable television within the last 90 days. NETWORK RESTRICTIONS
ABC, CBS, NBC, and FOX Channels are available only for homes (1) which cannot receive an acceptable picture from local ABC, CBS, NBC, and FOX affiliates via a conventional rooftop antenna and (2) which have not subscribed to cable television within the last 90 days.

ADULT SERVICE REGIONAL RESTRICTIONS
All adult programming must be prepaid before authorization. The following states have restrictions for subscribing to some adult services by satellite: Mississippi, Alabama, North Carolina, Oklahoma, Utah, Tennessee. Please consult a ORBIT COMMUNICATION CORPORATION customer service representative before ordering. All adult services are non-refundable and non-transferable.

BLACKOUT RESTRICTIONS - SPORTS PROGRAMMING
All sports programming is subject to blackout restrictions. Areas of blackouts are determined by the channels and/or sports associations, not ORBIT COMMUNICATION CORPORATION.
